The Appellate Division of the Genesee County Prosecutor’s Office is responsible for handling appeals in the Michigan Court of Appeals and the Michigan Supreme Court. This division responds to appeals initiated by defendants after their conviction and sentence. The division also initiates emergency appeals before trial and even during trial in the event of an adverse ruling.
The Appellate Division also monitors developments or changes in the law and advises the other divisions and the Prosecutor’s administrative staff of any developments or changes. The Appellate Division attorneys are often called upon to assist the criminal divisions when new issues in the law are raised in the district courts or the circuit court. They often appear in the district courts or the circuit court when legal or Constitutional issues are raised during the course of a criminal proceeding.
The Appellate Division is staffed by two assistant prosecutors, Managing APA Michael Tesner and APA Rebecca Jurva-Brinn.
